The following Purchase Terms and Conditions apply to your purchase of Pronunciation Workshop® Training Products. Please note that the terms vary depending on whether the program purchased is the Pronunciation Workshop® Trial Course, Complete Pronunciation Workshop® Video Training Course, Pronunciation Workshop® Live Training, and Enterprise Licensing Options.

Product Use information for the Pronunciation Workshop® Training Course Personal Edition

Our training products are subject to the applicable Pronunciation Workshop® End User License Agreement (“EULA”), and your access to our training programs are subject to the Pronunciation Workshop® Website Terms of Use Agreement and Privacy Policy.

Pronunciation Workshop® Training Course Personal Edition will be sent within 24 hours of the placement of your order. Pronunciation Workshop®Personal Edition affords no more than one individual and for personal use only, the ability to view and use the licensed software on a maximum of two personal devices. The training license begins on the Purchase Date and expires 12 months from Purchase Date. The Pronunciation Workshop®Course uses video streaming technology and requires Internet access to participate in the training.

Terms of Payment Agreement

Single Payment Option – If you elect to pay the purchase price in a single payment, the full purchase price will be charged to the payment method you select on the Order Page on the date the order is placed ("Purchase Date").

Easy Payment Plan Option – If you elect to pay via our 3 Easy Payment plan option, you will be charged in 3 separate installments over three consecutive months. You are obligated under this agreement to make all three payments. The first payment will be charged to the payment account you selected on the Order Page at the time of purchase ("Purchase Date"). Thereafter, your account will be charged for the remaining two payments. The second charge will occur one month from original purchase date, the third and final charge will occur two months from original purchase date. At which time your account will be paid in full.

Acceleration of Payment – You understand that Pronunciation Workshop® may accelerate payments by making a demand of immediate payment of all installments payable under this purchase contract if you are in default of your obligations under this purchase contract to make monthly installment payments when due or in the event that your charge card will expire prior to the dates scheduled in fulfillment of all payments due. 

Rights After Default of Payment– In the event that your credit or debit card is declined Pronunciation Workshop® will continue to make attempts in processing your payment. If and when a charge is successful Pronunciation Workshop® shall have the right to accelerate the maturity of the payments in processing the entire sum of the unpaid portion as provided above.

You agree that Pronunciation Workshop® shall have the right to terminate your access to the entire Pronunciation Workshop® Training Course Personal Edition until all payments are made and your account is paid in full.

Product Use information for the Pronunciation Workshop® Video Trial Course

Our training products are subject to the applicable Pronunciation Workshop® End User License Agreement (“EULA”), and your access to our training programs are subject to the Pronunciation Workshop® Website Terms of Use Agreement and Privacy Policy.

Pronunciation Workshop® Trial Course will be sent immediately following the placement of the order. During the Trial period over the next 7 days you will receive unlimited access to two Pronunciation Workshop® video training classes with matching Trial Training Manual. The trial period begins when order is submitted so if there are any questions or technical issues contact us immediately.

If you choose to receive our Complete Pronunciation Workshop®Training Program Personal Edition before the trial period ends you may send us an email with your request and we will send you full access to all 16 Pronunciation Workshop®training video classes and digital texts after your payment is processed. You may request either the one-time payment or our easy 3 payment plan.

After your Initial Trial Term, if you do not cancel within the 7 days, your purchase of the Pronunciation Workshop®Trial Course includes automatic enrollment into the Complete Pronunciation Workshop® Video Training Course Personal Edition, allowing you to conveniently continue your training. By purchasing today, you authorize Pronunciation Workshop®to automatically charge your credit card account upon the expiration of the Initial Trial Term of 7 days for the first of three monthly payments of $79.99 for three consecutive months at which time your account will be paid in full.

Terms of Payment Agreement

Pronunciation Workshop® Training Course Personal Edition will be sent following the expiration of the Trial term subsequent to the successful processing of the initial charge payment. Pronunciation Workshop® Personal Edition affords no more than one individual and for personal use only, the ability to view and use the licensed software on a maximum of two personal devices. The training license begins on the Purchase Date and expires 12 months from Purchase Date. The Pronunciation Workshop® Course uses video streaming technology and requires Internet access to participate in the training.

Single Payment Option – Once you have received the Digital Download of the Complete Pronunciation Workshop® Training Course Personal Edition you may elect to make a one-time payment following the process of the initial charge. Upon request, the balance of the full purchase price will be charged to the payment method you selected on the Order Page on the date the Trial order was placed ("Purchase Date") within 24 hours of your request.

Easy Payment Plan Option – Following the expiration of the Trial term you will be placed on our 3 Easy Payment plan option, the full payment price will be charged in 3 separate installments over three consecutive months. You are obligated under this agreement to make all three payments. The first payment will be charged at the end of your Initial Trial Term to the payment account you selected on the Order Page at the time of your Trial purchase. Thereafter, your account will be charged for the remaining two payments. The second charge will occur one month from the end of the Trial Term date, the third and final charge will occur two months from the Trial Term date. At which time your account will be paid in full.

Product Use information for Pronunciation Workshop® Personal Live Training

Pronunciation Workshop® Personal Live Training is subject to the applicable Pronunciation Workshop® End User License Agreement (“EULA”), and your access to our training programs are subject to the Pronunciation Workshop® Website Terms of Use Agreement and Privacy Policy.

Pronunciation Workshop® Personal Live Training details and scheduling information will be sent within 24 hours of the placement of your order. The Live training period begins on the Purchase Date and expires 365 days from Purchase Date. Pronunciation Workshop® Personal Live Training affords no more than one individual, the ability to attend interactive online private training.

Pronunciation Workshop® Personal Online Live Training is provided through Skype or other online services. If you do not already have a Skype profile, you can create a free basic account. Visit the Skype website (www.Skype.com) and download Skype's free software and create your free Skype account.

The Pronunciation Workshop® Individual Live Training is a 50-minute private one-to-one training session addressing your individual speech issues through instruction and a target-specific evaluation. The training is performed by a state licensed Speech Language Pathologist certified by the American Speech Language and Hearing Association. Upon completion of your training, you will be emailed a transcript of that session for review and practice.

All Pronunciation Workshop® Live Personal Training must be purchased and paid for in full prior to scheduling and setting session appointments for a Live session. Multi-session Packages are available and should be discussed with a Speech Language Pathologist for guidance and pricing.

Your Pronunciation Workshop® Personal Live training sessions may be scheduled in advance through our online calendar or via email.

Cancellation Policy

When changing or cancelling an appointment, you are required to do so at least 24 hours in advance by emailing Pronunciation Workshop®. Changes and cancellations made later than the 24 hour prior notification period will be considered as a session and be deducted from your training package and you will forfeit that training session without refund.  Changes or cancellations made prior to the 24 hour notification period will not be considered as a session and will not be deducted from your training package.

Product Use and purchase information for Pronunciation Workshop® Enterprise Licensing, including access rights and limitations for multi-user programs

Pronunciation Workshop® Corporate and Academic Licensed Software Guidelines apply to all Licensing Programs and Requirements related to organizations, institutions, users, devices, locations and facilities.

The purpose of these Licensing Guidelines is to establish acceptable practices as it applies to using the Pronunciation Workshop® Training Course Software. Pronunciation Workshop® reserves the right to modify these guidelines at anytime and for any reason without notice. Any changes to these guidelines will be posted and reflected on this web page.

Extent of licensing may include one or more of the following:  the number of end users, devices, locations (classrooms, labs, offices and campuses) and the duration of licenses (project, semester, semi-annual and yearly).

Site licenses are purchased to cover the entire enterprise. It grants permission and rights for multiple individuals to view the Pronunciation Workshop® Training Course Software on equipment throughout the organization.

Volume licenses are purchased in quantity. Pricing is based on the number of licenses purchased at one time for Pronunciation Workshop® Training Course Software, for use on a specific number of authorized computers typically a single computer lab, or by a specific number of authorized users whereby these and only these persons are authorized to use the Pronunciation Workshop® Training Course software.

Sponsored Individual license is purchased for a single individual within the organization for their own personal use. It is not to be shared or used as a teaching tool or for instructional purposes

User Responsibilities and Procedures

Participant has the right to use the Pronunciation Workshop® licensed training course software while affiliated with said organization under the licensing term agreement. That right is revoked upon termination of affiliation for any reason.

The Pronunciation Workshop® licensed training course software cannot be used by or given to anyone not affiliated with said organization.

Commercial or for-profit use of the Pronunciation Workshop® licensed training course is prohibited.

Licenses restrict the use of Pronunciation Workshop® licensed training course software for instructional purposes unless specifically and expressly stated in a separate licensing term agreement.

Guideline Statement

Organizations are responsible for using any Pronunciation Workshop® licensed training course appropriately and as noted in the respective course software licensing agreement. Pronunciation Workshop® expressly reserves the right to revoke any license granted for breach of these terms and to take any and all appropriate legal actions.

Pronunciation Workshop® End-User License Agreement (EULA)

Pronunciation Workshop® Courses are licensed for single users only unless expressly specified. It is illegal for single user products to be used by multiple users.

This End User License Agreement (“License”) is a contract between you (“Licensee”), the individual completing the order for, or installation of, or access to, or payment for, or the use of the Products, materials and/or services described below and Pronunciation Workshop® ("Licensor") and governs Licensee’s use of the Pronunciation Workshop® Products, materials, and/or services. The license granted hereunder is conditioned upon Licensee’s acceptance of the terms set forth herein.

“Pronunciation Workshop Products” means the Pronunciation Workshop® Training Products, including, without limitation, software, materials, password-protected access to a Licensor website, and any related products, materials, services, and documentation (together with any updates to, or new releases of, the foregoing that are made available to Licensee by Licensor) licensed by Licensor to Licensee pursuant to this License.

Important Notice on Pronunciation Workshop® Licenses

This license is a legal agreement between licensee and licensor. Licensee understands and acknowledges that licensor would not have entered into this license with licensee, without licensee’s agreement to be fully bound by the terms of this license.

Licensee acknowledges that licensee is electronically signing this license, and such electronic signature has the same legal force and effect as a handwritten signature. Licensee agrees to be legally bound by all of the terms, conditions and notices contained or referenced herein. If licensee does not agree to these provisions or any of the other terms of this license, do not click the acceptance button and do not purchase any Pronunciation Workshop® Training Products. Licensee consents to have this license provided to licensee in electronic form. Licensee has the right to receive, and may request, a non-electronic copy of this license either before or after licensee electronically signs the license.

The Pronunciation Workshop® Products is licensed, not sold. If Licensee accepts this License, and for so long as Licensee complies with the terms of this License, Licensor grants Licensee a nonexclusive and nontransferable license to use the Pronunciation Workshop® Products.

If Licensee has accepted access to the Pronunciation Workshop® Products, the License granted by Licensor gives Licensee use of the Pronunciation Workshop® Products from a personal computer or personal mobile device, for Licensee’s personal use only.

This License does not allow the Pronunciation Workshop® Products to be executed or made available, directly or indirectly, over any network or on more than two personal devices at a time without the prior written consent of the Licensor. Internet access is required to access Pronunciation Workshop® Products, and is not provided by Licensor. Such access is the sole responsibility of Licensee.

Licensee acknowledges that access to the Pronunciation Workshop® Products on a personal computer or mobile device will require permission through Pronunciation Workshop’s gateway, to lawfully access. Licensee will be required to comply with the Licensor-defined procedure to obtain full access to the Pronunciation Workshop® products. Pronunciation Workshop’s unique identifier assigned to each Licensee, is designed to prevent unlicensed or illegal use of the Pronunciation Workshop® Products. These measures allow Licensee’s access to the content, to ensure that each Licensee is an authorized user.

A unique Username and Password is provided to each Licensee as a personal login to rightfully access the material.  Licensee agrees that Licensor may use any measures to protect the Pronunciation Workshop® Products against software piracy. Licensee will not save Licensee’s login information on a workstation which may be used by multiple users, as doing so will cause Licensee to be in violation of this License.

Licensor reserves the right to collect and analyze data relating to Licensee’s use of the Pronunciation Workshop® Products through purchase, digital rights management and email. Licensor uses this data to improve the Pronunciation Workshop® Products, for marketing research, to make promotional offers from Licensor and to assess Licensee’s compliance with the terms and conditions of this License.

Licensee may not, and may not permit others to, directly or indirectly sell, rent, lease, loan, timeshare, or sublicense the Pronunciation Workshop® Products. The transmission of Licensee’s login, user name or password to allow any person other than Licensee to use Pronunciation Workshop® Products is expressly forbidden and failure to comply with this prohibition may result is the suspension or termination of the right to continue to use the Pronunciation Workshop® Products or receive support.

OWNERSHIP OF INTELLECTUAL PROPERTY

Licensor reserves all rights in the Pronunciation Workshop® Products not expressly granted to Licensee in this License. Licensee acknowledges and agrees that Licensor owns all rights, title and interest in and to the Pronunciation Workshop® Products (including all software, code, interfaces, text, photographs, graphics, animation, music, video and audio incorporated therein and any related user guides and documentation), the trademark Pronunciation Workshop®, the URLs, and other marks related to Licensor’s Products and URLs such as Pronunciation Workshop.com and the trade dress, look and feel of the Pronunciation Workshop® Products, all of which are covered by various protections including, without limitation, copyright, trademark, and trade secrecy law. If Licensee suggests new features or functionality that Licensor, in its sole discretion, adopts for the Pronunciation Workshop® Products, such new features or functionality will be the sole and exclusive property of Licensor and any and all claims of Licensee as to the same are hereby waived and released. Licensor reserves the right, in its sole discretion and without incurring any liability to Licensee, to update, improve, replace, modify or alter the specifications for and functionality of all or any part of the Pronunciation Workshop® Products from time to time.

Licensor offers support for the Pronunciation Workshop® Products for those of its customers. Licensor reserves the right to change its support policy (and to discontinue support for any Products) at any time and without notification to Licensee. Licensee’s use of Licensor’s customer support is governed by the hours of operation, and other terms and conditions set forth at Licensor’s website. Licensor reserves the right to make changes to the support policy at any time, and will post those changes on the support pages on Licensor’s website.

This License is effective until terminated. By accepting this License, Licensee authorizes Licensor to immediately terminate Licensee’s rights, without notice, under this License, including access to the Pronunciation Workshop® Products, if Licensee fails to comply with any terms of this License.

Upon receipt of notice of termination of this License, Licensee must immediately cease all use and delete all copies of the Pronunciation Workshop® Products. Licensor may require Licensee to certify in writing that Licensee has complied with this requirement.
